The Website is operated by SpaceTime Co., Ltd., a company registered in South Korea (“SpaceTime”, “we”, “us”, or “our”). Gallery SpaceTime is a division of SpaceTime Co., Ltd..

If you use the Website as an employee or representative of another legal entity, by using the Website, you indicate that you accept these Terms on behalf of yourself and such legal entity. If you do not agree to these Terms, please refrain from using the Website.

IMPORTANT NOTICE: NO E-COMMERCE TRANSACTIONS

Gallery SpaceTime operates exclusively through private sales and advisory services. This website does not facilitate direct e-commerce transactions, shopping cart functionality, or online payments. All artwork acquisitions are conducted through private negotiation and consultation.

CERTIFICATE OF AUTHENTICITY (COA) DISCLAIMER

While Gallery SpaceTime strives to provide accurate information about artworks, certificates of authenticity are issued based on available information and research at the time of sale. We make no absolute guarantees regarding attribution, provenance, or authenticity beyond what is explicitly stated in the certificate of authenticity provided with each artwork. See Section 6 (Disclaimers) and Section 7 (Limitation of Liability) for the scope of our warranties.

2. Intellectual Property

All the content of the Website, including all text, images, videos, sound recordings, documentation and software, as well as the design, graphics, and layout of the Website (the “Content”) is the proprietary property of SpaceTime Co., Ltd., and is protected by copyright laws, trademark, and other intellectual property laws.

The names, titles, trademarks, service marks and logos that appear on the Website, including without limitation SpaceTime, are registered marks of SpaceTime Co., Ltd.. Except as expressly set out in these Terms, you shall have no rights in respect of any such intellectual property rights.

The Content on the Website may not be used, copied, reproduced, distributed, modified, displayed, performed, created as derivative works of or used for any commercial purpose, in whole or in part, without first obtaining the written authorization of SpaceTime Co., Ltd. and permitted under these Terms of Use.

A. UNLAWFUL USE OF THE WEBSITE

You may access and view the content on the Website on your computer or another device. Unless otherwise specifically indicated in these Terms, use of the Website and the services offered on or through the Website are only for your personal, non-commercial use. The following are not permitted:

  • Unauthorized text/data extraction(mining) and/or storage of website content and metadata in the search system or inclusion in other computer programs or tasks, unauthorized distribution and hosting of website content through a third-party platform;

  • Reproduction of website content for commercial purposes or unauthorized use of content and ideas obtained or derived from the website;

  • Using any images, text, artwork descriptions, or other content from this website for training artificial intelligence (AI) or machine learning (ML) models without prior written consent from SpaceTime Co., Ltd.;

  • Automated scraping, crawling, or harvesting of artwork images or content using bots, scripts, or other automated tools;

  • Impersonating an individual or organization, including SpaceTime Co., Ltd. and its employees, agents or representatives;

  • Upload, post, transmit, or otherwise make available any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, libelous, obscene, indecent, or offensive materials that infringe on the privacy of artists belonging to Gallery SpaceTime;

  • Interfere with the operation of this Site or violate any security features;

  • Attempting to circumvent, disable, or interfere with security features, watermarks, or copy protection mechanisms on the website.

B. LINKING TO THE WEBSITE

You may connect via link from any website you own, as long as you do not violate the terms and conditions presented by this website in a fair and legitimate manner and do not damage the reputation of Gallery SpaceTime or SpaceTime Co., Ltd.. However, the link shall not be established in such a way that SpaceTime Co., Ltd. offers certain alliances, approvals, or warranties that do not exist or are not presented. Framing the content of a website (i.e., displaying the content of this website on any other website without permission) is strictly prohibited.

Consistent with this founding principle, SpaceTime Co., Ltd. and Gallery SpaceTime may employ artificial intelligence (“AI”) tools and generative technologies as instruments of creative exploration, research, and visual experimentation in furtherance of our institutional mission.

Where AI-generated imagery or other AI-generated content appears on this Website, such content is disclosed as AI-generated in accordance with applicable law, including Article 31 of the Republic of Korea’s Basic Act on the Development of Artificial Intelligence and the Establishment of Foundation for Trustworthiness (“Korean AI Basic Act”) and Article 50 of the European Union Artificial Intelligence Act (“EU AI Act”).

Purpose and Scope

The use of AI-generated content by SpaceTime Co., Ltd. is strictly limited to exploratory and experimental contexts consistent with our institutional mission to investigate the potential of emerging technology at the frontier of contemporary art. Such content is supplementary and editorial in nature. It does not represent the artistic output of Gallery SpaceTime’s represented artists, and is not intended to misrepresent authorship, substitute human creative expression, or mislead viewers as to the origin of any work.

Intellectual Property in AI-Generated Content

AI-generated content produced in connection with SpaceTime Co., Ltd.’s operations is claimed as proprietary to SpaceTime Co., Ltd. to the fullest extent permitted by applicable law. All rights in such content are reserved.

14. Entire Agreement

These Terms and Conditions are the complete statement of the agreement of the parties with respect to the subject hereof and supersede all prior agreements and understandings between the parties hereto with respect to the subject hereof. In order to be binding, any amendment or modification of this Agreement must be effected by an instrument in writing signed by the parties.
